EU Officially Launched Anti Circumvention Investigation On Chinese Shoe Enterprises

A few days ago, the European Union officially launched an anti circumvention investigation on the re export of China's leather shoes and "borrowing" from Macao to Europe. This is another severe test for China's export shoe industry after the EU, China's shoe enterprises and the imposition of anti-dumping duties. According to the EU anti-dumping law, if the leather shoes exported from the mainland of China to the EU are transshipped through Macao, the products will be subject to anti-dumping duties. China Light Industry and crafts import and Export Chamber of Commerce said that the anti circumvention investigation is as harmful to enterprises as the anti-dumping investigation, and the enterprises involved should be actively prepared to respond to the lawsuit. Anti circumvention investigation refers to that after the authorities of the investigating country take anti-dumping measures, some enterprises involved in the case will export the goods to the investigating country after processing or assembling the goods in a third place in order to avoid the anti-dumping measures. If the authorities of the investigating country find this situation, they may initiate an anti circumvention investigation to ensure the continued effectiveness of the anti-dumping measures. In the anti-dumping war in the past few years, Chinese shoe-making enterprises have not given up their efforts. On July 7, 2005, the EU launched an anti-dumping investigation on leather shoes, sports shoes and labor protection shoes made in China. At the end of April 2006, through the efforts of the shoe industry alliance formed by more than 100 enterprises, the EU cancelled the quota restrictions on Chinese shoes products, the anti-dumping duty rate was reduced from 19.4% to 16.5%, and the anti-dumping period was also reduced from five years to two years. Ministry of Commerce: we hope that the EU will handle cases related to China's footwear industry with caution. In view of the anti circumvention investigation launched by the EU against Chinese shoes, officials from the Ministry of Commerce today expressed strong opposition, believing that this is the continuation of the EU's anti-dumping case against Chinese shoes. For example, the director of the EU's China EU footwear trade bureau is not conducive to China's fair import and export of shoes. We hope that the EU will take prudent measures in anti circumvention investigation to avoid negative impact on China EU relations. We will pay close attention to this case and follow up the EU investigation process in strict accordance with the WTO agreement. Cheng yongru said that the EU's anti circumvention investigation on Chinese shoes is based on its own anti circumvention law, but the WTO law has no relevant provisions.
